Planning Law

The Planning Act regulates land use in Denmark with rules on planning, including municipal and local planning, as well as regulation of construction, etc. in rural zones and holiday home areas.

The law is constantly being amended by new initiatives relating to, for example, climate adaptation, protection against flooding, noise and odours, new opportunities for planning for renewable energy plants, energy parks, etc. In addition, the area is characterised by very extensive case law from the Planning Board of Appeal, which it is necessary to keep up to date with in order to be able to manoeuvre within the area.

Codex Advokater have considerable experience with this set of rules, and our assistance and advice includes:

  • Advice to municipalities’ technical administrations and other public authorities, with solution-oriented assessments and opinions, as well as assistance in complex cases and in appeals and court cases
  • Advice and guidance on the interaction between the Planning Act and other legislation, including the Building Act, the Road Act and, not least, the Environmental Assessment Act, which form a necessary focus area in the planning processes
  • Assistance in connection with expropriation under the Planning Act and other legislation, regarding both the expropriation process itself and the calculation of damages and subsequent valuation cases

  • Guidance for companies on the possibilities and limitations of the Planning Act in connection with the purchase of property, expansion of buildings and transfers

With Codex Advokater, you are guaranteed competent guidance across complex cases under the Planning Act.
