EU law has set – and continues to set – a fast pace, and the Danish Parliament is following suit. In the intervals between new legislation, both the European Court of Justice and the Danish courts and complaints boards ensure that the understanding of the specific application of the legislation is constantly adapted.
Codex Advokater has one of the largest and most experienced teams in the field of environmental law. Codex Advokater advises and litigates on all aspects of environmental law, and each member of the team has core competencies within a focus area, ensuring that we are always at the forefront of the latest legislation and case law.
Codex Advokater systematically monitors developments in case law and reviews, for example, every single decision made by the Danish Environmental and Food Appeals Board. We are also responsible for reporting on regulations in the Danish Journal of Environment, Climate and Energy, published by Djøf Forlag, and we have no fewer than three members of the editorial board, including the editor-in-chief, of Environmental Law Decisions and Judgments (In Danish MAD), published by KARNOV (Danish code of laws). In addition, we are commentators on a number of laws and executive orders in KARNOV’s collection of laws, including the Danish Environmental Assessment Act, the Habitat and Waste Executive Order, and we are behind the publication of Miljøret (Environmental Law), 10th edition, by KARNOV’s publishing house.
Codex Advokater collaborates with a number of course providers to share our knowledge, including in particular the Danish Freshwater Centre, KL Miljøjura, DAKOFA, EnviNa and the ATV Fund for Soil and Groundwater (ATV-fonden for Jord og Grundvand), and we also hold regular courses exclusively for municipalities and regions. We also serve as a member of the board of Danske Miljøadvokater (Danish Environmental Attorneys), ATV Fund for Soil and Groundwater and chair of the legal network in DAKOFA.
We advise municipalities and regions in their roles as authorities, operators or developers, but we also assist other public developers, including municipal and state development companies, and we do not take on cases where there is a risk that we will be in conflict with the interests of this client group, either specifically or in general.
